The debtor’s debt was formed before the bankruptcy. The company claimed the debt from the debtor, but was refused. We were able to prove that the debt is not eligible for inclusion in the creditors’ claim. Therefore, it should not be repaid in bankruptcy proceedings, but as a current payment in priority, before it is paid to creditors in bankruptcy proceedings (Case No. A45-12859/2009).
